District Attorney Brett Eby announced today that a Saratoga County jury found Michael A. Bertone (DOB: 11/24/1969) guilty on all three counts of Aggravated Family Offense (Penal Law § 240.75), Class E Felonies, following a trial in Saratoga County Court. The jury returned its unanimous verdict in less than three hours of deliberations.
The evidence at trial established that after previously threatening the victim by telephone, prompting her to obtain an Order of Protection, Bertone knowingly violated that court order by going to the victim’s residence and harassing her. Bertone is a six-time convicted felon whose repeated disregard for the law culminated in these convictions.
“This verdict is first and foremost a testament to the extraordinary courage of the victim,” District Attorney Eby said. “She stood up to her abuser, testified in open court, and endured the difficult process of trial to hold him accountable. Her bravery not only secured justice in this case but will help protect future victims from a career criminal who has repeatedly demonstrated that he has no respect for the law. She is truly a hero.”

District Attorney Eby also commended the outstanding police work of the Saratoga Springs Police Department, recognizing Officer Bryan Sterge, Officer Vinay Rathore, Officer Cameron Mandala, and Officer Michael Nadeau for their professionalism and dedication throughout the investigation and trial.
District Attorney Eby further recognized the invaluable contributions of Senior Assistant District Attorney Jennifer Pratt, Crime Victim Advocate Ashley Kitts, Investigator Timothy Sicko, and Investigator Joe Iwaniec for their teamwork and commitment throughout the prosecution.
Bertone faces a maximum sentence of 4 to 8 years in New York State Prison. Given his extensive criminal history, which includes six prior felony convictions, his continued pattern of criminal conduct, and his complete lack of remorse, the Saratoga County District Attorney’s Office will seek the maximum sentence permitted by law before the Honorable James R. Davis on October 16, 2026.
