Saratoga County District Attorney Brett R. Eby announced today that the Honorable James R. Davis sentenced Timothy W. Besaw (DOB: 05/31/1991) as a Second Felony Offender to a term of 12½ to 25 years in New York State Prison together with a sentence of 3½ to 7 years in connection with his April 1, 2026 plea in the Saratoga County Court.
Besaw had previously plead guilty to both Aggravated Vehicular Homicide, a Class “B” Felony, in violation of New York State Penal Law § 125.14(5), and Vehicular Assault in the First Degree, a Class “D” Felony, in violation of New York State Penal Law § 120.04(4) in connection with his late night, impaired operation of a motor vehicle that resulted in the death of one man and serious physical injury of another.
At 11:00 PM on October 16, 2025, in the Town of Wilton, Besaw was pursued outside Walmart by three employees who suspected him of shoplifting. When confronted, Besaw entered a nearby vehicle, rapidly accelerated, and intentionally swerved toward two of the employees, striking both individuals.
The Defendant fled the scene and subsequently crashed his vehicle into a secluded area of Wilton. Members of the New York State Police quickly located the Defendant, who appeared visibly impaired and refused to submit to a breath or blood test. Investigators recovered critical video and physical evidence from both the scene of the assault and the crash site. Inside the Defendant’s vehicle, law enforcement recovered multiple open containers of alcohol as well as controlled substances, all of which were seized as evidence.
District Attorney Eby stated, “Today’s sentence reflects the devastating consequences of the Defendant’s actions and holds him accountable for the immeasurable harm he caused. While no sentence can restore the life that was taken or erase the trauma inflicted upon the surviving victim and the families involved, we hope this outcome provides a measure of justice and closure. Our thoughts remain with the victim’s loved ones, whose strength and resilience throughout this case have been extraordinary.”

The case was prosecuted by General Felony Unit Bureau Chief Joseph A. Frandino and Assistant District Attorney Ryan Murphy, with the support of Crime Victim Specialist Mollie Benware and District Attorney Investigator Michael Hourigan.
