Saratoga County District Attorney Karen A. Heggen announced today that David T. Henderson (DOB 07/17/1976) of Fort Edward, NY was sentenced by Saratoga County Court Judge James A. Murphy, III to 8 years of incarceration in a state correctional facility, plus 3 years post-release supervision for his conviction of Criminal Possession of a Controlled Substance in the Third Degree, a Class “B” felony, in violation of New York State Penal Law Section 220.16(12). This conviction stems from an incident that took place on March 12, 2023 in the Town of Halfmoon, Saratoga County.
Henderson was arrested as part of an investigation by the Saratoga County Sheriff’s Office in coordination with other law enforcement agencies into drug dealing activities taking place across multiple counties. As part of the investigation, a search warrant was executed on defendant Henderson’s vehicle. That search revealed the defendant had nearly a half kilo of cocaine and numerous fentanyl pills in his possession. Henderson has at least five prior felony drug convictions. As part of the disposition and sentence, the 2019 SUV belonging to Henderson and used in this drug transaction was forfeited to be used for law enforcement purposes. The sentence today is part of a global disposition with Washington county, where Henderson also had drug charges.
District Attorney Heggen stated, “This case will have a big impact. As of late November 2023, there have been 38 fatal overdoses in Saratoga County and 647 non-fatal overdoses.* The deadly combination of cocaine and fentanyl has taken so many lives, and at the same time bail and discovery law changes have made it more difficult than ever to prosecute these cases. This case is an example that while true drug addicts need treatment, true drug dealers need prison. Henderson fit squarely in the latter category, preying on those with addictions. His conviction and sentence reflect his actions are those of a drug dealer.”
D.A. Heggen also lauded the work of the Saratoga County Sheriff’s Narcotics team for their investigation work. The case was prosecutive by Senior Assistant District Attorney Jesse L. Ashdown.
