Saratoga County District Attorney Karen A. Heggen announces that a Saratoga County Court trial jury today, October 30, 2024, found Jacob E. Krall (dob 5/14/2003) of Paisley Road in the Town of Milton, Guilty of Assault in the Second Degree, a Class “D” Violent Felony in violation of New York State Penal Law Section 120.05(9); and Guilty of one count of Endangering the Welfare of a Child, a Class “A” Misdemeanor, in violation of NYS Penal Law Section 260.10(1).  The jury found Krall not guilty of a separate count of Endangering the Welfare of a Child.  Saratoga County Court Judge James A. Murphy, III presided over the three-week trial.

The conviction stems from an incident that occurred at Defendant Krall’s home in the Town of Milton on and between March 18-19, 2023.  The jury found that the Defendant, who was over the age of 18, caused physical injury to a child less than seven years old.  Emergency services were called to the home in the early morning hours of March 19, 2023.  The First Responders found the victim baby unresponsive and immediately provided medical care.  The baby was transported to Albany Medical Center where the baby was treated for a brain injury, which included bilateral subdural hematomas and bilateral retinal hemorrhages.  The baby was in the hospital for over a week to receive treatment for these injuries.  With their verdict, the jury also found Defendant Krall knowingly acted in a manner likely to be injurious to the physical, mental or moral welfare of a child less than seventeen years old.

The case was prosecuted by Saratoga County District Attorney’s Office Special Victims’ Unit Bureau Chief Jennifer L. Buckley, with the assistance of Senior Assistant District Attorney Mary T. Northrup, assisted by Saratoga County District Attorney’s Office Investigator Michael P. Hourigan.   Bureau Chief Buckley and Senior ADA Northrup called over 16 witnesses, including four treating physicians and a forensic nurse examiner.  Investigator Anthony Pirrone was the lead investigator for the Saratoga County Sheriff’s Office.  He, along with the work of many other members of the Saratoga County Sheriff’s Office, completed a thorough investigation that identified civilian witnesses and over 100 items of evidence.

District Attorney Heggen praised the teamwork that resulted in this conviction: “Bureau Chief Buckley meticulously presented the complex medical and physical evidence to the jury, which demonstrated that Defendant Krall had caused physical injuries, including bilateral subdural hematomas and bilateral retinal hemorrhages, to the three-month-old victim.  The Saratoga County Sheriff’s Office investigation proved that the Defendant was the one who caused the baby’s injuries.” 

Sentencing is scheduled for December 19, 2024, at 10:00 am.  The defendant faces a maximum sentence of seven years determinate incarceration in a state correctional facility, to be followed by a period of post-release supervision.
