Saratoga County District Attorney Karen A. Heggen reports that late Friday, April 19, 2024, a Saratoga County Jury convicted Anthony P. Allen (DOB 1/15/1977), originally from New York City, of Robbery in the Third Degree, in violation of New York State Penal Law Section 160.05, a “Class D” felony, in connection with a September 7, 2023 robbery at the Intrada Apartments in Saratoga Springs.
The proof at trial proved that Defendant Allen followed the seventy-four (74) year-old victim into her apartment under the guise of assisting her with a large package and forcibly ripped the elderly victim’s adult Schwinn tricycle away from her. Defendant Allen then proceeded to flee the scene and hide in a nearby bathroom.
Members of the Saratoga Springs Police Department were called by a neighbor and were on the scene within minutes, located the tricycle in a nearby apartment, and returned it to the victim within an hour of the robbery.
The Defendant took the stand in his own defense at trial and maintained that he was the owner of the tricycle. The trial jury rejected Defendant’s claim after an extensive review of the video evidence together with testimony from several eyewitness, members of law enforcement, and the victim herself. The jury convicted the Defendant after deliberating for less than an hour.
Allen faces up to seven (7) years in State Prison on the robbery conviction when he is sentenced on June 28, 2024.
District Attorney Heggen thanked the Saratoga Springs Police Department, the civil witnesses and the crime victim for their hard work, perseverance, and commitment to ensuring that justice was achieved in this case. “Given law enforcement’s quick response and thorough investigation we were able to ensure the victim obtained her property back almost immediately and without any further altercation,” said Heggen. “Law enforcement was also able to swiftly download vital surveillance footage and obtain sworn statements from eyewitnesses that greatly assisted in the Defendant’s conviction.”
The case was prosecuted by Assistant District Attorneys Joseph Frandino and Alec Brennan together with District Attorney’s Office Investigator Jack Barney.
