Saratoga County District Attorney Karen A. Heggen announces that on July 10, 2024, Thomas R. McCall (DOB 11/12/1988) of Rensselaer, NY pled guilty to Criminal Possession of a Weapon in the Second Degree, a Class “C” Violent Felony in violation of New York State Penal Law §265.03(3) in the Saratoga County Court before the Hon. James A. Murphy, III. This plea satisfies the charges the Defendant faced from his March 25, 2024 arrest.
On the late afternoon of March 25, 2024 a member of the Saratoga Springs Police Department initiated a traffic stop of a vehicle traveling on South Broadway into Saratoga Springs. Following a brief interaction with the passengers, law enforcement located a Magnum .357 revolver together with ammunition underneath the driver’s seat of a vehicle within which the Defendant was a backseat passenger.
Further investigation determined that the firearm belonged to the Defendant— a thirty-five (35) year-old convicted felon from Rensselaer, New York— who also possessed heroin, fentanyl, and crack cocaine on his person. The Defendant had recently been admitted into the Albany County Drug Treatment Court Program, but was soon terminated given the Saratoga Springs arrest.
“Unfortunately, this is another example of convicted felons traveling northward to Saratoga Springs with loaded firearms and narcotics,” said District Attorney Heggen. “The unrelenting gun violence in the Capital Region is a stark reminder that these issues impact all of us throughout the area. I applaud the good work of the Saratoga Springs Police Department for their continued vigilance in protecting our citizens.”
The Defendant will be sentenced in Saratoga County Court on July 30, 2024 to five (5) years in State Prison, followed by five (5) years of post-release.
The case was prosecuted by Senior Assistant District Attorney Joseph Frandino together with District Attorney Office’s Investigator Jack Barney.
