Saratoga County, NY — Saratoga County District Attorney Brett R. Eby announced today that Timothy W. Besaw (DOB: 05/31/1991) pled guilty in Saratoga County Court before the Honorable James R. Davis to Aggravated Vehicular Homicide, a Class “B” Felony, in violation of New York State Penal Law § 125.14(5), and Vehicular Assault in the First Degree, a Class “D” Felony, in violation of New York State Penal Law § 120.04(4). The defendant will be sentenced as a second felony offender to a maximum term of 12.5 to 25 years in New York State Prison on the homicide charge, along with a concurrent term of 3.5 to 7 years for the vehicular assault against the second victim.
On October 16, 2025, in the Town of Wilton, the defendant was pursued outside Walmart by three employees who suspected him of shoplifting. When confronted, the defendant entered a nearby vehicle, rapidly accelerated, and intentionally swerved toward two of the employees, striking both individuals. The defendant fled the scene and subsequently crashed his vehicle into a secluded area of Wilton. The New York State Police located the defendant who appeared visibly impaired, and he refused to submit to a breath or blood test. The New York State Police recovered critical video and physical evidence from both the scene of the assault and the crash site. Inside the defendant’s vehicle, investigators located multiple open containers of alcohol as well as controlled substances, all of which were seized as evidence.
District Attorney Eby stated, “This was a senseless and devastating act that has permanently impacted so many lives. The strength, and resilience shown by the victim’s family in the face of such a horrific tragedy has been truly extraordinary, and our thoughts remain with them as they continue to endure this profound loss.”
District Attorney Eby also expressed appreciation for the coordinated investigative efforts that led to the resolution of the case, stating, “I want to thank our law enforcement partners for their swift and thorough work in building the case that led to this conviction. Their efforts, coupled with the dedication of our prosecutors and investigative team, ensured that justice was achieved in this matter.”
The Saratoga County District Attorney’s Office extends its gratitude to the members of law enforcement who contributed to this investigation, including Sr. Investigator Matthew Britten, Investigator Shannon Lind, Investigator Joe Port, Investigator Heath McCrindle, Investigator Carson Salaway, New York State Police Forensic Investigation Unit Forensic Scientist Tiffany Moreno, Trooper Frederick Butt, Trooper Brianna Gauthier, Trooper Matt Flynn, Trooper Joshua Tusang, Trooper David Henrie, and Trooper Anthony Villano.
The case was prosecuted by General Felony Unit Bureau Chief Joseph A. Frandino and Assistant District Attorney Ryan Murphy with the support of Crime Victim Specialist Mollie Benware and District Attorney Investigator Michael Hourigan.
The matter has been adjourned for sentencing until July 15, 2026 before the Honorable James R. Davis.
