District Attorney Brett R. Eby

Brett Eby is the District Attorney of Saratoga County and a lifelong resident of Saratoga County. Born and raised in Clifton Park, New York, he is a graduate of Shenendehowa High School.

Brett attended St. Bonaventure University, where he demonstrated early leadership and a strong commitment to service. While earning his undergraduate degree, he served as Class President, was a member of the university’s hockey team, contributed as a writer for the student newspaper, and volunteered with the Big Brother program.

He went on to attend Western Michigan University Cooley Law School. Brett put himself through law school while working as a teacher and tutor, and he also volunteered in an adult literacy program, reflecting his dedication to education and community engagement. He later earned a Public Sector Leadership Certificate from Cornell University.

Brett began his legal career at the Warren County District Attorney’s Office, where he was appointed Assistant District Attorney by the Honorable Kathleen B. Hogan. During his tenure, he handled a felony caseload and tried more than 50 cases to verdict. In 2018, he was appointed Special District Attorney for Warren County by District Attorney Jason Carusone, an appointment that was confirmed by the Warren County Board of Supervisors.

Brett also served as an Assistant Attorney General at the New York State Office of the Attorney General, where he defended men and women in uniform in Supreme Courts across the state. He later worked at the Justice Center for the Protection of People with Special Needs, safeguarding vulnerable populations from abuse and neglect. In this role, Brett led independent investigations and collaborated with a specialized team that included former law enforcement officers, registered nurses, and professionals with firsthand experience in agencies under the Justice Center’s jurisdiction, which spans more than one million individuals across six state agencies.

Following this work, Brett served as Principal Court Attorney to the Honorable Kathleen B. Hogan and the Honorable Paul E. Davenport in New York State Supreme Court.

Beyond his courtroom experience, Brett has been deeply involved in professional and community service. He served on the Board of Directors for the Northeastern New York Alzheimer’s Association and was appointed by Justice Stan L. Pritzker to serve on the Character and Fitness Committee, which investigates and evaluates applicants seeking admission to the New York State Bar.

Brett has also shared his legal experience as an adjunct professor at Sage College, teaching criminal law and trial practice, and has guest lectured at law schools and universities throughout New York State.

Brett Eby is a proud husband and father and remains actively involved in the community as a volunteer in the rescue community throughout the Capital District.
