Saratoga County District Attorney Karen A. Heggen reports that Saratoga County Court Judge James A. Murphy, III sentenced Jacob E. Krall (dob 5/14/2003) of Paisley Road in the Town of Milton, to the maximum sentence provided by law of 7 years incarceration in a state correctional facility, to be followed by 3 years of post-release supervision, for assaulting a 3-month-old baby March 18-19, 2023. Following a three-week trial, the Saratoga County Jury found Defendant Krall guilty of Assault in the Second Degree, a Class “D” Violent Felony in violation of New York State Penal Law Section 120.05(9); and Endangering the Welfare of a Child, a Class “A” Misdemeanor, in violation of NYS Penal Law Section 260.10(1).
The conviction stems from an incident that occurred at Defendant Krall’s home in the Town of Milton. The evidence at trial proved that the Defendant, who was over the age of 18, caused physical injury to a child less than seven years old. Special Victims’ Unit Bureau Chief Jennifer L. Buckley addressed the judge prior to sentencing. Ms. Buckley recounted the heroic actions of members of the Saratoga County Sherrif’s Office, including the desk officer who answered the 911 call from the Defendant’s home that reported the victim baby was unresponsive and provided the caller with life-saving instructions. Upon arrival at the Defendant’s home, the responding Deputy assisted the child until emergency medical services reached the scene and provided medical care as they transported the baby to Albany Medical Center. There, the baby was treated for abusive head trauma, which included bilateral subdural hematomas and bilateral retinal hemorrhages. The baby was in the hospital for over a week to receive treatment for these injuries. Ms. Buckley also noted to the Court the inconsistency of the Defendant’s various accounts to medical and law enforcement professionals. She highlighted that to this day, the Defendant has not accepted responsibility and has shown no remorse for the injuries he caused to the child.
Judge Murphy addressed Defendant Krall prior to imposing his sentence. The Judge reflected on the Defendant’s versions of what occurred and that those versions were filled with inconsistencies. The Judge also noted that Defendant’s “…cowardly variations of what happened demonstrate his lack of remorse and failure to take responsibility.” Judge Murphy imposed the maximum sentence of seven years in a state correctional facility followed by three years of post-release supervision for the conviction for Assault in the Second Degree, a Class “D” Violent Felony in violation of New York State Penal Law Section 120.05(9); and 364 days incarceration for the conviction for Endangering the Welfare of a Child, a Class “A” Misdemeanor, in violation of NYS Penal Law Section 260.10(1). By law, those sentences will run concurrently. Judge Murphy also imposed a full stay-away Order of Protection for the baby victim and their mother for a period of fifteen (15) years.
The case was prosecuted by Saratoga County District Attorney’s Office Special Victims’ Unit Bureau Chief Jennifer L. Buckley, with the assistance of Senior Assistant District Attorney Mary T. Northrup, assisted by Saratoga County District Attorney’s Office Investigator Michael P. Hourigan.
District Attorney Heggen commented, “This is a tragic case where a 3-month-old baby sustained abusive head trauma injuries at the hands of Defendant Krall, which may have a lifetime impact on the child. The maximum sentence imposed today by Judge Murphy is appropriate given the seriousness of the injuries sustained.”
