Saratoga County District Attorney Karen A. Heggen announces that Wilfredo F. Diaz (d.o.b. 12/10/72) was sentenced today by Saratoga County Court Judge James A. Murphy, III to a total of 51 1/3rd years to life in prison following his convictions in two separate trials in February and April, 2017. On February 10, 2017 Defendant Diaz was found guilty in Saratoga County Court of two counts of Predatory Sexual Assault, in violation of Penal Law Section 130.95(3), Class “A-II” felonies; one count of Sexual Abuse in the First Degree, in violation of Penal Law Section 130.65(1), a Class “D” violent felony and One Count of Assault in the Second Degree, in violation of Penal Law Section 120.05(6), a Class “D” violent felony. Diaz was also convicted on April 7, 2017 in a separate trial of Failing to Register as a Sex Offender, in violation of New York State Corrections Law Section 168-t, a Class “E” felony. Today Judge Murphy imposed sentencing for each of these convictions: 25 years to life incarceration for each count of Predatory Sexual Assault, to run consecutively; 7 years incarceration for Sexual Abuse in the First Degree, to be followed by a period of post-release supervision of 15 years; 7 years incarceration for Assault in the Second Degree, to be followed by a period of post-release supervision of 5 years; and 1 1/3rd to 4 years incarceration for Failing to Register as a Sex Offender. Judge Murphy ordered that the sentences for each Predatory Sexual Assault charge shall run consecutively, for a total of 50 years to life. The Sexual Abuse in the First Degree and the Assault in the Second Degree are to run concurrently with each other and with the 50 years to life sentence, as required by law. The Failing to Register as a Sex Offender was directed to run consecutively to the other sentences for a total aggregate sentence of 51 1/3 years to life. Judge Murphy also imposed fines and surcharges of $1,425.00, and issued an Order of Protection in favor of the victim for 100 years from today’s date.
